1) DISCUSSION QUESTION

Today, there are several options for people who want to pursue a legal claim. This includes filing a lawsuit in court, but also includes alternative forms of dispute resolution (referred to as ADR) such as mediation and arbitration. In both mediation and arbitration, the dispute is resolved outside of court, with the main difference being that mediation requires the parties to voluntarily agree to a resolution, while arbitration requires the parties to abide by the decision of a private arbitrator.

For this discussion, choose one of the disputes listed below and explain whether you think the best way to resolve it is through a lawsuit, mediation, or arbitration.

  • A woman is passed over for promotion and instead the job is award to a man with less experience. She believes that this is a case of sex discrimination.
  • A truck driver is hit by a motorist who ran a stop sign and will be in the hospital for several months and does not have any savings or disability benefits.
  • A child is injured when a very popular folding high-chair collapses, and it appears that the high-chair was improperly designed and unable to reliably support the weight of the average infant.

Hello Professor and Classmates,

The Topic I chose was

    • A child is injured when a very popular folding high-chair collapses, and it appears that the high-chair was improperly designed and unable to reliably support the weight of the average infant.

      This case would have had to been solved through a lawsuit. Not only was my child injured, but could have been killed if he hit his head hard enough on the floor when the chair collapsed .As a parent we buy things for our children for their safety ,so products like this should be tested over and over and over and over again. Beings though its a “popular” product I’m assuming that it would actually be an Class Action lawsuit. Besides from that consumers have rights when it comes to defective products. We are protected under the Findlaw.


      The law provides numerous remedies for the affects of dangerous consumer products,The two main legal theories for product defect cases are negligence and strict liability.

A woman is passed over for promotion and instead the job is award to a man with less experience. She believes that this is a case of sex discrimination.

I believe this case could be solved through mediation. She could take it to court and sue the company, however it could be a simple misunderstanding. There are to many facts to consider, just because someone has seniority does not mean they are right for the job. She also is not aware of what kind of experience she has, maybe the company is going in a new direction and want a new insight. Also if she is wrong she can create tension in the workplace and start off on the wrong foot with the new person who has the promotion. If she settles this through mediation she can be compensated to a degree and cause less stress in the workplace.
