Virginia has decided to crack down on child labor, including the previously tolerated
practice of parents and neighbors paying children for chores, odd jobs, and babysitting.
The Virginia legislature determined that all child labor distracts from education, leading
to a less able workforce, increased drug use, and burgeoning prisons. Virginia's new
law, the Child Education Enhancement Act, positively forbids all child labor.
The Wilson family believes that work is part of education due to the tasks learned while
working and because of the money management skills that it facilitates. They also argue
that working enhances family closeness through teambuilding. After paying their
children (ages 8, 10, & 12) $25 each a week for various chores (no child worked more
than five hours) and permitting the eldest to babysit for the neighbors at the rate of $8
an hour for two hours a week, the Wilsons are arrested and convicted. On appeal, the
Wilsons challenge Virginia's child labor laws.
