Mexicans Eventually Became U Please Write A Memor
Three months have passed since you prepared the memorandum for the Maori tribal chief from New Zealand. He has circumnavigated the globe, studying legal systems and their impacts on varied cultures around the world. He makes an appointment with you and expresses his appreciation for your memorandum explaining how American laws and the American legal system have negatively impacted Chicanx and other Latinx in the United States. He is curious because your paper, while discussing negative impacts, alluded to some positive impacts as well.He asks for a memorandum from you explaining the ways that American laws and the American legal system have positively impacted, or facilitated the advancement of Chicanx and Latinx in the United States.
Please write a memorandum to the tribal chief, using what you think are the most significant cases from your reader and casebook; the relevant law.Your explanation of the positive effects of the law(s) and the legal system on Chicanx and Latinx in the United States may be informed by scholarly material written on the matter found in your assigned reading materials, films shown in class, or lecture material. All materials utilized must have reference citations.
Focus on the fact that not all of the cases we have studied illustrate negative impacts on Latina/os, or other racial or ethnic groups.Rather, we have seen the law evolve and fluctuate. As a result, there have been many cases that illustrate triumphs for Latinx, or have otherwise facilitated their advancement in American society.Review at least four of the broad areas of the law we have studied (i.e. Use of Race in University Admissions, Education, Criminal Law, Jury Representation, Employment Discrimination, Immigration, Marriage, Latina Feminism, etc.) and find particular cases that you can argue have broken barriers for Latina/os and have had lasting positive effects. As only an example, even the Treaty of Guadalupe Hidalgo and its interpretations had some positive impacts on Latinx.(Some land grants survived the Land Commissions, Mexicans eventually became U.S. citizens, and a Santa Barbara Judge was found to be a citizen under the Treaty, preserving his elective office.)Some cases have, at the same time, had negative as well as positive impacts on the Latina/o community.
